You have probably already read about this, maybe even here, where we learned more, but Dave Grohl and The Foo Fighters are suing Marvel Comics for illegally using "substantial excerpts" of two songs in a recently released trailer.
The band comprised of Grohl, drummer Taylor Hawkins, guitarist Pat Smear and a couple other guys whose names I don’t know are taking exception to the comic giant using snippits the songs "Best of You" and "Free Me" in the promotional video for the new "Wolverine and The X-Men" cartoon without paying royalties. And they are pissed.
Marvel appears to be taking this seriously and has pulled all copies of the video off the ‘net.
OK, honestly, somebody on one of the two sides screwed up here. There
is no way that Marvel, a well-known and respected company, accidently
forgot to get clearence on the samples before releasing the commercial.
If not did they really expect one of the largest bands in the world
(who just had a featured preformance at The Grammy’s of all small
venues) to not notice if two of their bigger singles were included in a
highly anticipated trailer release? Doubt it.
I am going to suspect a Foo legal Fighter forgot to clue the band in on
the approved clearance. From what I have found, that happens more than
many realize (see 1996’s Coolio v. Yankovic, Al). Or Marvel is really
that ballsy. I doubt it.
